Price Protection Budget Plan Enrollment

1. A minimum annual fuel usage of 400 gallons is required to participate in this budget plan.
2. The first payment must be received along with the signed contract. Thereafter, payments are due on the first of each month. Payment will be considered acceptance of the terms outlined in this agreement.
3. Customers are enrolled in Automatic Delivery and will remain on this status until a cancellation request is submitted in writing or via email.
4. Customers who opt out of automatic payments must have a valid credit card on file. If budget payments are not made within 30 days, the balance will be charged to the card.
5. To participate, your account must remain current. Payments are due by the 15th of each month to avoid a late fee. Any non-budget balances outstanding will be charged to the credit card on file. All accounts must be brought current within 30 days or the contract becomes null and void.
6. Fuel usage estimates are based on the customer's three-year history or other available usage data. If the customer exceeds the estimated gallons, monthly payments may be adjusted accordingly.
7. Customers must ensure safe and clear access to fill pipes and/or tanks at all times, including the removal of snow and ice. Carroll County Oil reserves the right to charge for wrecker services if a delivery vehicle requires towing.
8. At the end of this contract, we reserve the right, if more than 25% of the estimated gallons remain unused, to assess a liquidation damage charge. The charge will be the difference between the contract fuel price and the cash price as of the final date of the contract.
9. Any remaining credit at the end of the contract must to used to purchase additional services from Carroll County Oil.
10. The capped price for this agreement is $3.39 per gallon, accepted upon receipt of payment. Carroll County Oil assumes all risk if prices rise above this amount and agrees to provide the lowest price available on the day of delivery, whether it is the capped or market price. Note: Capped prices are subject to change without notice based on market volatility and the price per gallon of this agreement is not locked in until first payment is received.
11. The price per gallon of this agreement is for delivered fuel only and does not include local, state or federal tax, tariff, sales tax, fees, customs, or duties (collectively, “taxes”) required by law or assessed against, directly, or indirectly, fuel. All taxes will be charge to the account separately.
12. The cap protection fee is $0.30 per gallon and is billed to the account at the start of this agreement. This fee is non-refundable.

14. Due to the volatile nature of the heating fuel market, early termination of the contract is subject to a liquidation damage charge. This charge is calculated as the difference between the contract and market prices at the time of termination, multiplied by the remaining unused gallons. In addition, an early termination fee of $550.00 will apply.

THE AGREEMENT EXERCISED IN THIS CONTRACT IS IN COMPLIANCE WITH MAINE STATE LAW SECTION 10 MRSA § 1110
